Terms of Service

1. Definitions

Throughout these Terms of Service ("Terms"), the following definitions apply:

  • "Service" means the ListingBooster.ai platform, including all web applications, APIs, and related services.
  • "User," "you," "your" means any individual or entity that accesses or uses the Service.
  • "We," "us," "our" means ListingBooster.ai and its operators.
  • "Content" means any text, images, descriptions, articles, social media posts, or other materials created, uploaded, or generated through the Service.
  • "AI-Generated Content" means any Content produced in whole or in part by artificial intelligence models through the Service, including listing descriptions, social media posts, SEO articles, featured images, and market research.
  • "Organization" means a team or business entity account under which multiple Users may operate.
  • "Credits" means the units of Service usage allocated under the Agent Edge (Sprint) subscription plan, consumed when generating content.
  • "Agent Edge" means the subscription product providing AI-powered listing optimization, social media content creation, and autopilot posting features.
  • "Authority Engine" means the subscription product providing SEO article generation, keyword research, CMS publishing, and cooperative backlink network features.
  • "Autopilot" means the automated social media posting feature that schedules and publishes content to connected social media accounts without requiring individual post approval, unless the User has enabled the "Require Approval" setting.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age;
  • Be a licensed real estate professional, an authorized representative of a licensed real estate professional, or operating in a jurisdiction where no real estate license is required for your intended use;
  • Have the legal authority to bind any Organization on whose behalf you are registering;
  • Not be located in a jurisdiction where use of the Service is prohibited by applicable law.

By creating an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility and to suspend or terminate accounts that do not meet these requirements.

3. Account Registration and Security

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for safeguarding your account credentials, including any passwords and authentication tokens.

By connecting third-party accounts (such as social media OAuth tokens or CMS credentials), you authorize us to store and use those credentials on your behalf solely to provide the Service. You must notify us immediately at support@listingbooster.ai if you become aware of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms. Each individual may maintain only one account unless explicitly authorized by us in writing.

4. Description of Service

ListingBooster.ai is an AI-powered real estate marketing platform that provides the following capabilities:

  • Listing optimization for MLS, AI search engines, and traditional search;
  • Social media content creation and automated posting (Instagram, Facebook, Twitter/X, LinkedIn, TikTok, Threads);
  • SEO article generation, keyword research, and topic clusters;
  • Featured image generation using AI (DALL-E 3);
  • One-click CMS publishing (WordPress, Webflow, Notion, custom webhooks);
  • Cooperative backlink network for mutual SEO benefit;
  • Market research and neighborhood analysis;
  • Content quality scoring and Fair Housing compliance checking;
  • Domain authority monitoring and weekly reporting.

The Service is NOT a lead generation tool, a licensed real estate brokerage, or a provider of real estate advice. The Service does not offer legal, financial, or professional real estate counsel. Any marketing content generated through the Service is for informational and promotional purposes only.

5. Subscription Plans, Billing, Credits, and Refunds

The Service offers the following subscription plans:

  • Agent Edge (Sprint): $59.95/month — 400 credits per month, AI-optimized listing descriptions, social media content creation, 30-day social media autopilot, brand voice customization.
  • Authority Engine (Marathon): $59.99/month — up to 30 SEO articles per month, unlimited keyword research, automated backlink network, weekly domain authority monitoring, one-click CMS publishing.
  • Bundle (Agent Edge + Authority Engine): $99.95/month — all features from both plans combined.

All payments are processed through Stripe. We do not store your credit card numbers on our servers; all payment card data is handled by Stripe in accordance with PCI DSS Level 1 requirements.

Credits reset at the beginning of each billing cycle. Unused credits do not roll over to subsequent months. Subscriptions automatically renew at the end of each billing period. You may cancel at any time; upon cancellation, you retain access to the Service through the end of your current billing period. No partial-month refunds are provided.

Promotional codes and referral codes, when applicable, may modify the general billing terms described herein. We reserve the right to change pricing with at least 30 days' prior notice. If a payment fails, we will provide a grace period before downgrading your account.

6. AI-Generated Content — Ownership, Accuracy, and Limitations

Upon generation, you receive a perpetual, non-exclusive, royalty-free license to use, modify, and distribute AI-Generated Content created through your use of the Service.

Copyright status of AI-generated works is currently unsettled. The U.S. Copyright Office has stated that works generated solely by AI without sufficient human authorship may not be eligible for copyright registration (see Thaler v. Perlmutter, No. 1:22-cv-01564, D.D.C. 2023). We make no representation or warranty regarding the copyrightability of AI-Generated Content, and copyright protection may vary by jurisdiction.

AI-Generated Content may contain errors, inaccuracies, or hallucinations. You have sole responsibility to review, verify, and correct all AI-Generated Content before publishing or distributing it. There is no guarantee of uniqueness — similar inputs from different Users may produce similar or identical outputs.

The Service uses multiple AI models, including those provided by OpenAI, Anthropic (Claude), Google (Gemini), and Perplexity (Sonar). Image generation uses DALL-E 3 via OpenAI. We do not guarantee which specific model will be used for any given request, as the Service employs fallback routing between providers.

By using the Service, you grant us a non-exclusive license to process your input data (property details, agent profile, custom instructions, photos) through these AI providers for the purpose of generating Content on your behalf.

7. AI Disclosure Requirements

You acknowledge that the Federal Trade Commission (FTC) has issued guidance regarding the disclosure of AI-generated content in commercial communications. Additionally, various states and localities may have enacted or may enact laws requiring disclosure when content is generated or substantially assisted by artificial intelligence.

You are solely responsible for complying with all applicable AI disclosure requirements in your jurisdiction. While the Service may provide optional AI disclosure labels or acknowledgment features, we do not guarantee that these tools satisfy all applicable legal requirements, and we are not responsible for your failure to comply with disclosure obligations.

As part of onboarding, you will be asked to acknowledge your understanding of AI disclosure obligations. This acknowledgment is for informational purposes and does not constitute legal advice or shift compliance responsibility to us.

8. Fair Housing Act Compliance

The Service includes built-in Fair Housing compliance tools, including AI-powered content moderation and policy checklist gates designed to help identify potentially discriminatory language. However, these tools are assistive only and are not a guarantee of compliance.

You are solely responsible for ensuring that all content you publish complies with the Fair Housing Act (42 U.S.C. §§ 3601–3619) and all applicable state and local fair housing laws. Prohibited conduct includes, but is not limited to, discrimination in housing-related advertising on the basis of race, color, religion, sex (including gender identity and sexual orientation), handicap/disability, familial status, or national origin.

We reserve the right to flag, block, edit, or remove any Content that we reasonably believe violates fair housing laws. Repeated violations may result in account suspension or termination. You agree to indemnify and hold us harmless from any claims, damages, or penalties arising from Fair Housing violations in Content you publish.

9. NAR Code of Ethics and Professional Standards

If you are a member of the National Association of Realtors (NAR) or any affiliated board, you agree to use the Service in compliance with the NAR Code of Ethics, including but not limited to:

  • Article 2: Avoiding exaggeration, misrepresentation, or concealment of pertinent facts relating to the property or the transaction;
  • Article 12: Presenting a true picture in advertising, marketing, and other representations, and ensuring that all materials are not misleading.

The Service is not a substitute for your professional judgment. Compliance with MLS formatting rules, local board regulations, and professional standards remains your sole responsibility.

10. Acceptable Use Policy

You agree not to use the Service to:

  • Engage in any illegal activity, including fraud, harassment, spam, or impersonation;
  • Generate content that is defamatory, obscene, threatening, or that violates any third party's rights;
  • Misrepresent property features, pricing, availability, or other material facts;
  • Create fabricated testimonials, reviews, or endorsements;
  • Generate content for properties you are not authorized to market;
  • Reverse engineer, decompile, or disassemble any aspect of the Service;
  • Scrape, crawl, or extract data from the Service beyond authorized API usage;
  • Circumvent rate limits, usage quotas, or other technical restrictions;
  • Attempt prompt injection attacks or otherwise manipulate AI models to bypass safety measures;
  • Share account credentials, API keys, or authentication tokens with unauthorized parties.

Violations of this Acceptable Use Policy may result in a graduated response including: written warning, temporary suspension, permanent termination, and/or reporting to relevant authorities. We reserve the right to determine the appropriate response in our sole discretion.

11. Social Media Posting Authorization

By connecting your social media accounts (Instagram, Facebook, Twitter/X, LinkedIn, TikTok, Threads) to the Service, you explicitly authorize us to post Content to those accounts on your behalf.

OAuth tokens for connected accounts are securely stored by the Service. You may revoke authorization at any time by disconnecting your account through the Service settings.

Autopilot Feature: When Autopilot is enabled, the Service will schedule and publish social media posts automatically without requiring your approval for each individual post, unless you have enabled the "Require Approval" setting. You understand and accept that posts made via Autopilot are published in your name and on your behalf.

We are not responsible for violations of any social media platform's terms of service resulting from Content posted through the Service. You are independently responsible for complying with each platform's terms, community guidelines, and advertising policies.

12. CMS Publishing Authorization

By providing your CMS credentials (WordPress, Webflow, Notion, or custom webhook endpoints), you authorize us to publish Content directly to your websites and content management systems.

All CMS credentials are encrypted using AES-256-GCM encryption before storage. You are responsible for ensuring that your credentials remain valid and that you have appropriate access permissions on the target CMS. You may revoke publishing authorization at any time by disconnecting your CMS integration.

We are not responsible for CMS downtime, formatting inconsistencies, content display issues, or any damages resulting from publishing operations. It is your responsibility to verify published content on your CMS.

The Authority Engine includes an optional cooperative backlink network. By opting in, you grant permission for other participating Users' websites to link to your published content, and for your published content to link to theirs, based on topic overlap and relevance scoring.

We do not guarantee any SEO benefit from participation in the backlink network. Backlinks are verified periodically, and either party may reject a proposed match at any time. You may withdraw from the backlink network at any time through your account settings.

14. Data Accuracy and Content Review Obligation

You represent and warrant that all property data you provide to the Service is accurate and that you are authorized to market the properties for which you create content.

You must review ALL AI-Generated Content before publishing. AI models may hallucinate property features, fabricate neighborhood details, produce incorrect pricing or square footage, or generate misleading statements. Quality scores provided by the Service are advisory only and do not constitute a guarantee of accuracy or compliance.

Market research generated through the Service may contain outdated or inaccurate information. You are solely liable for any consequences arising from publishing Content that you have not adequately reviewed and verified.

15. Web Scraping and Data Extraction

The Service uses Firecrawl to extract listing data from URLs you provide. By submitting a URL for extraction, you represent and warrant that you have the right to access and use the data at that URL for real estate marketing purposes.

We are not responsible for the accuracy of scraped data. It is your responsibility to verify all extracted information before using it to generate Content.

16. Intellectual Property

The ListingBooster.ai name, logo, trademarks, user interface, underlying code, algorithms, and proprietary technology are and remain our exclusive property (or that of our licensors). Nothing in these Terms grants you any ownership interest in the Service itself.

You retain ownership of all input data you provide to the Service, including property details, photos, agent profile information, brand voice settings, and custom instructions. You grant us a non-exclusive, worldwide, royalty-free license to process, store, and transmit your input data solely for the purpose of providing the Service.

AI-Generated Content is licensed to you as described in Section 6. We retain the right to use anonymized, aggregated patterns derived from Service usage for the purpose of improving the Service, without identifying you or your clients.

17. DMCA and Copyright Complaints

We respect intellectual property rights and respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512). To file a takedown notice, contact our designated DMCA agent at support@listingbooster.ai with the following information:

  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing and its location within the Service;
  • Your contact information (name, address, telephone, email);
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner;
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner;
  • Your physical or electronic signature.

Counter-notifications may be submitted in accordance with 17 U.S.C. § 512(g). We maintain a policy of terminating accounts of repeat infringers in appropriate circumstances. For AI-Generated Content that infringes third-party copyrights, the User who generated and published such content bears responsibility.

18. Team and Organization Terms

If you create or join an Organization, the following additional terms apply:

  • Organization owners are responsible for all activity within their Organization;
  • The role hierarchy is: Owner → Admin → Agent. Permissions are determined by role;
  • Owners control billing and subscription management for the Organization;
  • Property data and generated content may be shared among Organization members based on access settings;
  • When a member is removed from an Organization, their access to Organization data is terminated immediately;
  • Prior to dissolving an Organization, the owner must export any data they wish to retain;
  • The person who invites a new member to an Organization is responsible for verifying the invitee's eligibility.

19. API and Webhook Usage

If you create API keys through the Service, the following terms apply:

  • API keys are issued with scoped permissions (e.g., properties:read, properties:write, generate:descriptions, generate:social, usage:read). You may only use keys within their authorized scope;
  • API keys must be kept confidential. You must immediately revoke any key you believe has been compromised;
  • Rate limits are enforced per key. Exceeding rate limits may result in temporary throttling or key revocation;
  • Webhook endpoints must use HTTPS. Retry delivery is provided on a best-effort basis;
  • API usage is logged and may be audited. Abusive usage may result in immediate key revocation and account suspension.

20. Beta Programs and Early Access

We may offer beta programs or early access features from time to time. Beta features are provided "as is" with additional disclaimers beyond those in Section 21. Beta features may be modified, suspended, or discontinued at any time without notice.

Feedback you provide regarding beta features may be used to improve the Service without compensation or attribution. No service level agreement (SLA) applies to beta features, and beta access may expire at any time.

21. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, UNIQUE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF THE THEORY OF LIABILITY. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM:

  • Fair Housing violations in Content you publish;
  • Actions taken by social media platforms against your accounts;
  • Changes in search engine rankings or SEO performance;
  • CMS publishing errors or formatting issues;
  • AI provider outages, model changes, or content quality fluctuations;
  • Reliance on AI-Generated Content without independent verification.

22. Indemnification

You agree to indemnify, defend, and hold harmless ListingBooster.ai, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Content you create, publish, or distribute through the Service;
  • Your violation of these Terms;
  • Fair Housing violations in Content you publish;
  • Your failure to disclose the AI-assisted nature of Content where required by law;
  • Misuse of connected social media accounts;
  • Errors or damages resulting from CMS publishing;
  • Your participation in the cooperative backlink network;
  • Your violation of any third party's rights.

We will provide you with reasonable notice of any such claim and will cooperate with your defense. We reserve the right to participate in the defense of any claim at our own expense.

23. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Before initiating any formal dispute resolution, you agree to first contact us at support@listingbooster.ai to attempt informal resolution. You and we will make good faith efforts to resolve any dispute informally for at least thirty (30) days.

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions: Either party may bring claims in small claims court (for disputes under $10,000) if the claims qualify. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Opt-Out: You may opt out of this arbitration provision by sending written notice to support@listingbooster.ai within thirty (30) days of creating your account.

24. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Florida. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.

25. Termination

By you: You may terminate your account at any time by canceling your subscription and requesting account deletion through your account settings or by contacting support@listingbooster.ai.

By us for cause: We may suspend or terminate your account immediately if you violate these Terms, engage in fraud, fail to pay, commit repeated Fair Housing violations, or engage in other conduct we reasonably determine to be harmful to the Service or other Users.

By us without cause: We may terminate your account for any reason with at least thirty (30) days' prior written notice.

Effect of termination: Upon termination, your access to the Service ceases, and your account enters a soft-delete state with a 30-day retention period before permanent deletion. Any outstanding payment obligations survive termination. Data retention following termination is governed by our Privacy Policy.

The following sections survive termination: Definitions (1), AI-Generated Content (6), Intellectual Property (16), Limitation of Liability (21), Indemnification (22), Dispute Resolution (23), Governing Law (24), and Severability (27).

26. Modifications to Terms

We may modify these Terms at any time. For material changes, we will provide at least thirty (30) days' advance notice via email to the address associated with your account. Non-material changes become effective upon posting to the Service.

The Service tracks which version of these Terms you have accepted. If you do not agree to modified Terms, you may terminate your account before the effective date of the changes. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.

27. Severability, Force Majeure, Entire Agreement

Severability: If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, AI provider outages or model discontinuations, cloud infrastructure failures, internet service disruptions, and acts of terrorism or war.

Entire Agreement: These Terms, together with our Privacy Policy and any applicable Order Forms, constitute the entire agreement between you and us regarding the Service. No waiver of any provision shall be effective unless in writing and signed by the waiving party.
